For all sales contracts concluded via the online shop www.below50.net, the following general terms and conditions of sale apply between the seller, Below 50 (hereinafter also referred to as 'we' or 'Below 50'), and the buyer, who is a consumer (hereinafter also referred to as 'you'). These general terms and conditions apply to the purchase of products, without the intention of resale, by non-professional buyers on the Below 50 website.

1. Order/Conclusion of the sales contract

In order to place an order on our website, you must have legal capacity and not purchase a product with the intention of reselling it.

By clicking the 'order and pay' button, you place a firm order for the items in your shopping cart. We confirm the receipt of your order by email.
A purchase contract comes into effect between the two parties: Below 50 and yourself.

Below 50 reserves the right to refuse an order for justifiable reasons.

Below 50 also reserves the right to cancel a purchase (accepted order) for justifiable reasons.

Justified refusals of orders and cancellations of purchases do not entitle any compensation but rather the reimbursement of the product price if already paid.

Justifiable reasons include: product not available in stock (you can wait for restocking or obtain a refund); incorrect or unverifiable banking details; order identified as unusual or prone to fraud; we have reason to believe your purchase is intended for resale; the sale price indicated on the website contained an error; the address you provided is outside the geographical delivery area.

2. Price and Payment Method

Below 50 reserves the right to modify the prices of products listed on its website.

In the case of a manifest error in the price of a product, Below 50 is not bound by its offer and will give you the option to cancel your order or confirm it at the actual price of the product communicated by Below 50.

The prevailing prices are those indicated at the time of the order. All prices include the value-added tax (VAT) applicable in the consumer's country, except for deliveries to Switzerland where the sales prices are exclusive of taxes. In this case, VAT, customs fees/taxes must be settled by you directly with the carrier upon receipt of the product.

For deliveries to the United Kingdom, VAT is included in the sales price, but any customs fees/taxes are not included in the price displayed on the website. If applicable, these fees must be settled by you directly with the carrier upon receipt of the product.

Shipping costs are not included in the prices indicated on the products. Shipping costs depend on the mode and location of delivery. Shipping costs are added to the product prices for the calculation of the total amount to be paid.

The sole payment method is payment by credit card. For this type of transaction, Below 50 partners with Saferpay (Worldline). Saferpay (Worldline) uses a 3D Secure security protocol following PCI DSS standards for transaction security. Despite all our efforts to secure payments, there is always a low risk of fraud. Below 50 cannot be held responsible for damages resulting from the use of electronic communication and payment means.

3. Delivery

For deliveries to the United Kingdom, VAT will be included in the sales price; delivery terms will be defined during February 2024.

Order processing time: the package leaves our premises within 1 to 2 business days after order confirmation. For orders placed on Friday, the package will be shipped on Monday.

3.2
Delivery time: your package is delivered by La Poste using 'Colissimo suivi' within 3 to 8 business days. It will be delivered to the delivery address indicated on your order form. Therefore, it is important to be precise and complete regarding your delivery address. Deliveries are made on business days. In case of absence, the carrier leaves you a notice indicating the conditions for collecting your package (location, schedule, and collection deadline).

Please note that in case of return of your package due to delivery impossibility (for example, incomplete or incorrect address), or if you do not collect your package within the time limit set by La Poste, your package will be returned to us. The return and processing fees will be at your expense and will be deducted from your refund.

Delivery delay: unless indicated, all items for sale on our site are in stock. The delivery times indicated are those announced by our carriers, in business days. We are not responsible for any delays La Poste might have.

Damaged package: we advise you not to accept a damaged package (packaging showing visible signs of opening and/or damage) without issuing a reservation with the carrier. Indeed, packages leaving our warehouses are always in perfect condition and should be delivered to you as such. If a damaged package has been deposited in your mailbox or received by your concierge or a third party, the package is considered 'accepted as is.' You will have to address this matter with the carrier. We are not responsible in case of disappearance (theft) or damage to one or more items. We cannot provide compensation.

4. Return

4.1
Sale items are neither refunded nor exchanged.

4.2
Great care is taken with our products and the processing of your order. However, if despite our efforts, your purchase does not satisfy you, know that you have a maximum period of 14 days from the receipt of the package to retract and return the items to us.

4.3
For any return request, there is a procedure to follow: you must first contact us by email (info@ubidoca.com/subject of the email: return below50) by completing a withdrawal form (click here). Once we have responded to you, please print our reply email and the withdrawal form duly completed and signed to enclose them in your return package. These two documents are considered return vouchers. They are essential.

Please note that return costs (transportation costs, possibly customs fees/taxes) are at your expense.

The returned goods are under the responsibility of the consumer until they reach us.

4.6
All returned items will be subject to inspection. They must be packed, new, labeled, unused, unwashed, and in their original condition.

4.7
A refund (excluding return shipping/tax costs) will only be made upon receipt of the goods and provided they are in a condition complying with the return conditions described in the T&Cs.

4.8
The return will be refused and will not entitle to a refund in the following cases:

a) You have returned your package without following the procedure in point 4.3 (formulate your return request by email by completing and signing the withdrawal form, then wait for our response before returning your package)

b) Our reply email and the withdrawal form duly completed and signed were not included in your return package

c) The returned product is incomplete, damaged, washed, used, dirty, worn (except for trying on), modified, or altered

d) The product labels have been removed

e) The package was returned to the wrong address

5. Availability

If, despite the care we take in managing our stocks, an order has been validated while the ordered product(s) are not available in stock, Below 50 reserves the right to cancel the order. In case of cancellation of your order by us, we will refund you.

5.2
Our offers are valid for the entire duration they are visible on our website or between the dates indicated if it is a commercial operation for a defined period.

In case of a manifest error in the offer, Below 50 is not bound by its offer and will give you the option to cancel your order or confirm it under the actual conditions of the offer.

6. Liability

Below 50 is liable only in case of breach of its contractual obligations according to the terms of the applicable law.

Below 50 shall not be liable for any damage suffered by a third party resulting from the use of any of our products.

Below 50 shall not be liable for any damage resulting from your misuse of any of our products.

Below 50 is not responsible for damages resulting from incorrect information on its website.

Your essential personal data for each order are collected, processed, used, and stored by us in accordance with the corresponding legal provisions on data protection for the purpose of contract execution and safeguarding legitimate interests. For solvency checks, in accordance with data protection legal provisions, we may request information from information agencies and provide these agencies with personal data concerning the supply contract relationship. In case of doubts about your solvency, we have the right to refuse the conclusion of the contract.

These general terms and conditions of sale, as well as any dispute that may arise from them, or arising from the use of the website or purchases made on the Below 50 website, are governed by Swiss law. The legal venue is at 1920 Martigny (VS), Switzerland.
